17.(1) An application under section 8 may be dismissed by the Board, at any stage of its proceedings, in respect of all or any of the debts to which it relates,- (a) if, for reasons to be stated in writing, the Board does not consider it desirable or practicable to effect a settlement of debts, or (b) if, in the opinion of the Board- (i) the applicant fails to pursue his applications with due diligence, or (ii) the debtor is attempting to use the provisions of this Act with a view to defraud any creditor or any person referred to in clause (d) of sub-section (1) of section 11. (2) An application under section 8 shall be dismissed by the Board, if in its opinion- (a) such application includes a claim which is intended to defraud any creditor; or (b) there has been transfer of any property by the debtor within two years previous to the date of such application with a view to defraud any creditor.
