40. Whenever the Authority are satisfied- (a) that any street laid out or altered by the Authority has been duly levelled, paved, metalled, flagged, channelled, sewered and drained in the manner provided in the plans sanctioned by the Government under sub-section (2) of section 29; (b) that such lamps, lamp-posts and other apparatus for the lighting of such street as ought to be provided by the Authority have been so provided, and (c) that water and other sanitary conveniences ordinarily provided in a ¹[within the Corporation] have been duly provided in such street, the Authority shall pass a resolution to that effect and shall call upon the Corporation to take over such street as and from the date fixed by such resolution for the purpose.
