79. A person subject to this Ordinance who commits an offence of murder against a person not subject to service law, or of culpable homicide not amounting to murder against such a person, or of rape in relation to such a person, shall be deemed to be guilty of an offence under this Ordinance and shall be tried by a naval tribunal, provided he commits any of the said offences,-(a) while on active service;(b) at any place outside Bangladesh; or(c) at any place specified by the Government by notification in this behalf.
