PREVENTION OF SMUGGLING - POWERS OF SEARCH, SEIZURE AND ARREST-ADJUDICATION OF OFFENCES

Special powers for Magistrates
185. Notwithstanding anything contained in the Code of Criminal Procedure, 1898, and subject to the other provisions of this Act, any Magistrate of the first class specially empowered by the Government in this behalf may pass a sentence of imprisonment for a term exceeding 1[five years] and of fine exceeding 2[ten thousand Taka] for an offence under this Act.
