Statement or confession of accused persons

14. (1) 1[Any Judicial Magistrate or Metropolitan Magistrate] may record any statement or confession made to him by an accused person at any time in the course of investigation or at any time before the commencement of the trial.

 
 
 
 

(2) The Magistrate shall, before recording any such confession, explain to the accused person making it that he is not bound to make a confession and that if he does so it may be used as evidence against him and no Magistrate shall record any such confession unless, upon questioning the accused making it, he has reason to believe that it was made voluntarily.

 

2[(3) An accused shall have the right not to be compelled to testify or to confess guilt and to remain silent, without such silence being a consideration in the determination of guilt or innocence.]
