The Special Powers Act, 1974

Powers of Special Tribunals
1[28. Notwithstanding anything contained in the Code or in any other law for the time being in force,-
 
 
 
 
(a) a Special Tribunal consisting of a Sessions Judge, an Additional Sessions Judge or an Assistant Sessions Judge may pass upon any person convicted by it any sentence authorised by law for the punishment of the offence of which such person is convicted;
 
 
 
 
(b) a Special Tribunal consisting of a Metropolitan Magistrate or a Magistrate of the first class may pass upon any person convicted by it any sentence authorised by law for the punishment of the offence of which such person is convicted except death, 2[imprisonment for life] or imprisonment for a term exceeding seven years and fine exceeding ten thousand taka.]
