14. Subject to the provisions of this Ordinance, the pension payable to a Judge who is entitled to a pension under section 13 shall be calculated-(a) in the case of a Judge who was not a member of a service in Bangladesh or who immediately before his appointment as Judge did not hold any other pensionable civil post in the service of the Republic, in accordance with the provisions of Part I of the First Schedule;(b) in the case of a Judge who was a member of a civil service in Bangladesh or who immediately before his appointment as a Judge held any other pensionable civil post in the service of the Republic, in accordance with the provisions of Part II of the First Schedule unless he elects to receive pension under Part I of the said Schedule.
