400. (1) No fishing vessel shall proceed to sea unless the skipper and the engine driver are duly certificated by the Government, nor shall any person not so certificated accept any such employment in respect of any such vessel: Provided that a fishing vessel not less than seventy five gross registered tons shall carry at least one skipper, one second hand and two engine drivers who are duly certificated by the Government. (2) The Government may make rules providing for-(a) the manner in which and the conditions upon which such certificates shall be granted; (b) the suspension and cancellation of such certificate;(c) the inquiries and investigation into the conduct of the holders of such certificates. (3) Any person who,-(a) having been engaged as a skipper, second hand or engine driver goes to sea as such without being duly certificated, or(b) employs a person in contravention of sub section (1), without ascertaining that the person is duly certificated,shall, for each offence, be punishable with fine which may extend to five thousand Taka.
