Chapter IV

OF AID AND INFORMATION TO THE MAGISTRATES, THE POLICE AND PERSONS MAKING ARRESTS

Public when to assist
42. Every person is bound to assist 1[any Magistrate whether Judicial or Executive] or police officer reasonably demanding his aid,-
 
 
(a) in the taking or preventing the escape of any other person whom such Magistrate or police-officer is authorized to arrest;
 
 
(b) in the prevention or suppression of a breach of the peace, or in the prevention of any injury attempted to be committed to any railway, canal, telegraph or public property.

    The words “any Magistrate whether Judicial or Executive” were substituted for the words “a Magistrate” by section 20 of the Code of Criminal Procedure (Amendment) Act, 2009 (Act No. XXXII of 2009) (with effect from 1st November, 2007).
