Chapter X

PUBLIC NUISANCES

Magistrate may prohibit repetition or continuance of public nuisance
143. A District Magistrate or 1[any other Executive Magistrate] empowered by the Government or the District Magistrate in this behalf, may order any person not to repeat or continue a public nuisance, as defined in the Penal Code or any special 2[* * *] law.

    The words “any other Executive Magistrate” were substituted for the words and comma “Sub-divisional Magistrate, or any other Magistrate” by section 52 of the Code of Criminal Procedure (Amendment) Act, 2009 (Act No. XXXII of 2009) (with effect from 1st November, 2007).

    The words "or local" were omitted by section 3 and 2nd Schedule of the Bangladesh Laws (Revision And Declaration) Act, 1973 (Act No. VIII of 1973)
