Chapter XLIV

OF THE TRANSFER OF CRIMINAL CASES

(2) [The Chief Metropolitan Magistrate or 1[Chief Judicial Magistrate or District Magistrate] may withdraw any case from, or recall any case which he has made over to, any Magistrate subordinate to him, and may inquire into or try such case himself, or refer it for inquiry or trial to any other such Magistrate competent to inquire into or try the same.

    The words “Chief Judicial Magistrate or District Magistrate” were substituted for the words “any District Magistrate or Sub-divisional Magistrate” by section 94(b) of the Code of Criminal Procedure (Amendment) Act, 2009 (Act No. XXXII of 2009) (with effect from 1st November, 2007).
