Bangladesh House Building Finance Corporation Order, 1973 এর অধিকতর সংশোধনকল্পে প্রণীত অধ্যাদেশ
যেহেতু নিম্নবর্ণিত উদ্দেশ্যসমূহ পূরণকল্পে, Bangladesh House Building Finance Corporation Order, 1973 (President's Order No. 7 of 1973) এর অধিকতর সংশোধন করা সমীচীন ও প্রয়োজনীয়; এবং
যেহেতু সংসদ ভাঙ্গিয়া যাওয়া অবস্থায় রহিয়াছে এবং রাষ্ট্রপতির নিকট ইহা সন্তোষজনকভাবে প্রতীয়মান হইয়াছে যে, আশু ব্যবস্থা গ্রহণের জন্য প্রয়োজনীয় পরিস্থিতি বিদ্যমান রহিয়াছে;
সেহেতু গণপ্রজাতন্ত্রী বাংলাদেশের সংবিধানের ৯৩(১) অনুচ্ছেদে প্রদত্ত ক্ষমতাবলে রাষ্ট্রপতি নিম্নরূপ অধ্যাদেশ প্রণয়ন ও জারি করিলেন:-
১। (১) এই অধ্যাদেশ Bangladesh House Building Finance Corporation (Amendment) Ordinance, 2026 নামে অভিহিত হইবে।
(২) ইহা অবিলম্বে কার্যকর হইবে।
২। Bangladesh House Building Finance Corporation Order, 1973 (P.O. No.7 of 1973), অতঃপর উক্ত Order বলিয়া উল্লিখিত, এর Article 12 এর পরিবর্তে নিম্নরূপ Article 12 প্রতিস্থাপিত হইবে, যথা:-
“12. The Board may form a Standing Committee, Audit Committee, Shariah Committee and any other committee as it may consider necessary to assist it’s work and may determine the number of members of such committee and their duties and functions.”।
৩। উক্ত Order এর Article 21 এর clause (10) এর পরিবর্তে নিম্নরূপ clause (10) প্রতিস্থাপিত হইবে, যথা:-
“(10) The rate of interest chargeable on loans made by the Corporation shall be determined by the Board with the prior approval of the Government from time to time.”।
৪। উক্ত Order এর Article 29 এর পরিবর্তে নিম্নরূপ Article 29 প্রতিস্থাপিত হইবে, যথা:-
“29. The net annual profits of the Corporation shall be utilized in the following manner:-
(1) After making due provision for loans and advances, depreciation of assets, and such other liabilities as are ordinarily provided for by banking institutions, the Corporation may, out of the remaining profits, establish one or more reserve funds as may be approved by the Board.
(2) The residual surplus, after the allocations referred to in clause (1), shall be appropriated as follows:
(a) such portion thereof as may be declared by the Board, with the prior approval of the Government, shall be paid to the Government as dividend; and
(b) the remaining balance shall be transferred to the retained earnings of the Corporation.”।
৫। উক্ত Order এর Article 29A এর পরিবর্তে নিম্নরূপ Article 29A প্রতিস্থাপিত হইবে, যথা:-
“29A. For the purpose of the Income-tax Act, 2023 (Act No. XII of 2023), the Corporation shall be deemed to be a Company within the meaning of that Act and shall be liable to pay minimum income tax accordingly.”।
৬। উক্ত Order এর Article 30 এর clause (1) এর পরিবর্তে নিম্নরূপ clause (1) প্রতিস্থাপিত হইবে, যথা:-
“(1) The Corporation shall maintain its accounts and prepare an annual statement of accounts.”।
