The Protection and Conservation of Fish Act, 1950 (East Bengal Act)

( ACT NO. XVIII OF 1950 )

[ 18th May, 1950 ]

Penalties

1[5. (1) The breach of any rule made under section 3 or of any prohibition notified under section 4 shall be punishable with rigorous imprisonment for a term which 2[may extend to 2 (two) years, or with fine which may extend to 5 (five) lakh] Taka, or with both.

 
 

(2) The breach of any prohibition, described in section 4A, in connection with-

 
 
 
 

(a) manufacture, fabrication, import, marketing or storing of Current Jal by any person shall be punishable with rigorous imprisonment for a term which 3[may extend to 3 (three) years, and shall also be liable to fine which may extend to 10 (ten) lakh] Taka; and

 
 
 
 

(b) carrying, transporting, owning, possession or use of Current Jal by any person shall be punishable with rigorous imprisonment for a term which 4[may extend to 1 (one) year, or with fine which may extend to 2 (two) lakh] Taka, or with both.]

    The words, numbers, brackets and comma “may extend to 2 (two) years, or with fine which may extend to 5 (five) lakh” were substituted for the words and comma “shall not be less than one year and may extend to two years, or with fine which may extend to five thousand” by sections 4(a) of The Protection and Conservation of Fish (Amendment) Ordinance, 2025 (Ordinance No. 34 of 2025).

    The words, numbers, brackets and comma “may extend to 3 (three) years, and shall also be liable to fine which may extend to 10 (ten) lakh” were substituted for the words and comma “shall not be less than three years and may extend to five years, and shall also be liable to fine which may extend to ten thousand” by sections 4(b)(i) of The Protection and Conservation of Fish (Amendment) Ordinance, 2025 (Ordinance No. 34 of 2025).

    The words, numbers, brackets and comma “may extend to 1 (one) year, or with fine which may extend to 2 (two) lakh” were substituted for the words and comma “shall not be less than one year and may extend to three years, or with fine which may extend to five thousand” by sections 4(b)(ii) of The Protection and Conservation of Fish (Amendment) Ordinance, 2025 (Ordinance No. 34 of 2025).
