Chapter X

OFFENCES, PENALTIES AND PROCEDURE

Driving when mentally or physically unfit to drive
145. Whoever drives a motor vehicle in any public place when he is to his knowledge suffering from any disease or disability calculated to cause his driving of the vehicle to be a source of danger to the public, shall be punishable 1[for a first offence with fine which may extend to five hundred Taka and his driving licence shall be suspended for a specified period and for a subsequent offence with imprisonment for a term which may extend to three months, or with fine which may extend to five hundred Taka or, with both].

    The words and commas “for a first offence with fine which may extend to five hundred taka and his driving licence shall be suspended for a specified period and for a subsequent offence with imprisonment for a term which may extend to three months, or with fine which may extend to five hundred taka, or with both” were substituted for the words “with fine which may extend to one thousand taka and his driving licence shall be cancelled” by section 23 of the Motor Vehicles (Amendment) Act, 1990 (Act No. XIX of 1990)
